1. Introduction
El Mercado de Origen is an online marketplace (the “Marketplace”) that allows individuals over the age of 18 to register on the website (the “Customer”) and purchase new products from third-party suppliers through El Mercado de Origen, at prices and under conditions set by the sellers themselves. “Products” means any physical goods marketed by sellers on El Mercado de Origen. “Sellers” means legal entities previously approved by El Mercado de Origen that offer their products for sale through the Marketplace. El Mercado de Origen reserves the right to amend this information as necessary to comply with applicable law without prior notice. These Terms and Conditions apply together with the general terms of use of www.elmercadodeorigen.com.
2. Purpose
To establish the conditions under which El Mercado de Origen makes products sold by third-party sellers available to Customers through the Marketplace.
3. How the Marketplace works
The Marketplace allows Customers to browse and purchase products sold by Sellers. Transactions made through the Marketplace are entered into directly between the Customer and the relevant Seller, in accordance with the legal requirements applicable at the time. El Mercado de Origen does not act as agent, distributor or representative of the Sellers, nor as reseller of the Products offered by Sellers through the Marketplace. Products advertised and sold through the Marketplace are the sole responsibility of the respective Sellers, particularly as regards ownership, quality, safety, origin, warranties and compliance with applicable law. Online sales are valid only within Spain.
4. Customer
A Customer may purchase through the Marketplace only after accepting these Terms and Conditions and the Privacy Policy without restriction or reservation. Acceptance is recorded electronically when the Customer accepts these Terms and Conditions during a purchase on the El Mercado de Origen website.
5. Conditions of sale
The price and conditions of sale of Products offered through the Marketplace are the sole responsibility of the respective Sellers. Shipping methods, corresponding costs and delivery areas are also determined by the respective Sellers. Prices are shown in euros and include all applicable taxes and charges. Shipping costs may or may not be included in the displayed price and can be reviewed when the Customer proceeds to checkout.
6. Purchase
The purchase process is completed independently by the Customer through the Marketplace. When purchasing on the El Mercado de Origen website, the Customer must accept these Terms and Conditions. After payment, the order must be accepted by the Seller; acceptance or rejection generates an information email to the Customer. If the order is rejected, the amount paid will be refunded. Delivery is the responsibility of the respective Seller. El Mercado de Origen is not the Seller of products purchased through the Marketplace and does not assume liability arising from transactions between Customers and Sellers.
7. Formation of the purchase contract between Customer and Seller
El Mercado de Origen is not the Seller of products purchased through the Marketplace. The Seller identified for each Product is the party that enters into the purchase and sale contract with the Customer. Purchase contracts for Products offered by Sellers are formed between the Seller and the Customer subject to product availability. Sellers must confirm acceptance of an order within a maximum of 72 (seventy-two) hours after receiving it. If a Seller does not accept the order within that period, the purchase contract between the Customer and Seller will be automatically terminated and amounts paid by the Customer will be refunded.
8. Invoicing
Issuing the invoice is the sole responsibility of the Marketplace Seller. The Seller will issue the invoice in accordance with the tax rules and requirements applicable at the time.
9. Dispatch and delivery
Dispatch and delivery of Marketplace orders are the sole responsibility of the respective Sellers. Once an order has been placed, its details cannot be changed, particularly the shipping method, delivery address and recipient contact details. El Mercado de Origen does not take part in the delivery process.
10. Confirmation of receipt
The Customer is responsible for confirming receipt of the Products and that they conform to the order. Products will be presumed received 21 (twenty-one) days after the respective dispatch date. This provision does not limit or affect consumer rights provided by law.
11. Problems on receipt
If an order does not reach the Customer, arrives damaged, or does not match the information provided by the Seller at the time of purchase, the Customer may submit a claim directly to the relevant Seller. El Mercado de Origen will only assist as an intermediary with non-conformity issues for up to 45 (forty-five) days after the purchase. After that period, the matter must be handled directly between the Customer and Seller. Products purchased through the Marketplace cannot be returned to El Mercado de Origen or exchanged by El Mercado de Origen for other products. Returns are the Customer’s responsibility and must be arranged directly with the relevant Seller. Return conditions should be consulted on the respective Seller’s page at www.elmercadodeorigen.com. Disputes must be resolved directly between the Customer and the Seller.
12. Right of withdrawal
Under applicable law, the Customer has 14 (fourteen) days from receipt of the ordered Product(s) in which to withdraw from the contract with the Seller. Returning the Products is the Customer’s responsibility and must be arranged directly with the Seller; El Mercado de Origen does not take part in the return process. The Customer bears the cost of returning the goods unless the Seller expressly agrees to bear that cost. If the Seller does not offer to collect the goods, the Customer must return the Products to the Seller within 14 (fourteen) days after communicating the decision to withdraw. El Mercado de Origen will refund the amount paid for returned Products within a maximum of 14 (fourteen) calendar days from the date on which the Seller confirms receipt and conformity of the returned order, or the Customer provides El Mercado de Origen and/or the Seller with evidence that the goods have been returned.
